Stand by Letter of Credit - SBLC with no upfront payment

Amount Range: 10 M to 500 M ( In SBLC, client must have payment arrangement that would be done after delivering swift.


Description of Instruments:
1. Instrument:                          Fresh Cut Bank Guarantee / Standby Letter of Credit
2. Total Face Value:                € 500 MILLION
3. Issuing Bank:                      TOP BANK
4. Validity:                                One Year 
5. Lending Price:                     10% of Face Value plus 2% Borrower / Lender Agent  commission / fees                                           
6. Delivery:                              Bank-To-Bank Swift MT 760 (WITHOUT ANY PRE- ADVICE OR RWA)                                                                  
7. Payment:                              Wire Transfer MT 103 OR Settlement by POST-DATED CHECK                                                        
8. Hard Copy:                         Bonded Courier within 7 banking days after payment (of Agents’ Fee Commission) 


PROCEDURE: 
1. LENDER / BORROWER EXECUTE THE DEED OF AGREEMENT (DOA) THEREBY MAKING IT A FULL RECOURSE CONTRACT. WITHIN 3 BANKING DAYS UPON COUNTER SIGNATURE OF THE DOA, CLIENT THROUGH HIS BANK WILL ISSUE AN IRREVOCABLE CORPORATE POST-DATED CHEQUE FOR €50 MILLION TO SECURE THE LEASING FEE (10%) IN THE NAME OF SELLER COMPANY BEING THE BENEFICIARY SPECIFICALLY NOMINATED FOR THE PURPOSE OF THIS TRANSACTION UNDER A SPECIFIC ESCROW ARRANGEMENT BETWEEN THE LENDER AND THE SAID NOMINATED BENEFICIARY OF THE CHECK.

2. A COLOR SCANNED COPY OF THE POST-DATED CHEQUE MUST BE SENT TO EMAIL ADDRESS xxxxxxxxxxxxxxxxxx FOR APPROVAL BY THE LENDER. ONCE APPROVED, THE ORIGINAL CHECK MUST BE SENT BY DHL OR ANY OTHER RENOWNED COURIER SERVICE TO SELLER (ATTENTION: MR. MUHAMMAD TAUSEEF) UNDER A SPECIFIC COVERING LETTER (SPECIMEN ATTACHED);

3. BORROWER WILL RELEASE PAYMENT OF THE 2% COMMISSION FEES TO THE BORROWER / LENDER AGENTS WITHIN 5 BANKING DAYS UPON CONFIRMATION OF THE MT 760 SWIFT OF THE BG / SBLC AT THE BORROWER’S BANK WHILE BORROWER WILL HAVE TO WIRE TRANSFER THE LEASING FEE (10%) TO THE LENDER´S NOMINATED ACCOUNT NOT LATER THAN 3 BANKING DAYS FROM THE DATE MT 760 HAS BEEN RECEIVED BY THE BORROWER´S BANK. ON RECEIPT OF LEASE FEE, POST-DATED CHECK SHALL BE RETURNED.

Should Borrower default to pay the agents’ commission fees as agreed after 7 banking days of confirmation of BG/SBLC MT760 in Borrower's bank account, Lender will instruct the issuing bank to put a claim on the BG/SBLC thereby forcing the Borrower’s bankers to return the BG / SBLC MT760 to the issuing Bank. 
NOTE THAT THE BG/SBLC HARD COPY WILL ONLY BE DELIVERED AFTER AGENTS’ FEE COMMISSION HAS BEEN FULLY PAID.
N.B. THIS DEED OF AGREEMENT (DOA) ONCE COUNTERSIGNED, HAS A VALIDITY OF 10 BANKING DAYS ONLY – IF BORROWER FAILS TO ISSUE POST-DATED CHECK FOR €50 MILLION, THIS DOA IS AUTOMATICALLY RENDERED NULL AND VOID.
